Os princípios na China

Os princípios também causam problemas na China. Leia a seguinte resenha sobre a dissertação "The Theory of Principle-applied Judgment: Based on the questions of the current judicial practical theories in China", publicada na Latest Science:  
As the result that the positive laws could not provide the judgments grounds for all the cases,the judges always have to face upon the dilemma to be loyal or be betrayed to the law. Therefore,the current active judicature becomes a common sense in current situation.
And whether the next step would be the space-exited of judicial discretion outside the rules as Hart said or be the necessary limits to avoid the abuses by judges and what extent should be the limits to the active judicature.
All of these questions in practices and theories guide us to the direction of the principle judgment in western judicature.The construction of legal system turns into the period of transformation in China and the judicial practices would go ahead.
The courts in different ranks have made some number of cases fitted with legal principles "bravely",but the activities of principle judgments haven't been emphasized by the academia.There are a lot of arguments regarding these judgments in some different areas today and the public and the experts both question upon their certainty and the justification.
So the problem of "how the legal principles apply" is an issue that the courts must encounter.
After the attempts by the case of the heritage in Luzhou,the current studies and researches are still rest on the introductions of the western prevalent practices and theories, which is leave far away.So it's necessary to make the positive researches on the current conditions about the legal principles judgments in order to find out the origins and the Chinese contexts for this problem and get the some further arrangements and perfections for this sort of judgments.These are the tasks the author tries to achieve in this dissertation. And the main structures and approaches in this paper are following:
Chapter 1 is to analyze the classical cases in the bulletin of Supreme Court as the samples to explore the situation regarding the principle judgments in China that the most principal-applied cases take place in the civil areas and the principles are usually the basic rules in the civil law as the principles of honesty and fair not the general principle with the certain rights and obligations.In the method of application of principles,many applied cases are lacking of the abundant legal reasoning in the judgments and the arguments of the legal rules but to make the judgments depend on the principles directly except for some special cases.The random applications of the principles trigger the high ratios of the second or the final judgments and the different judgments over the same case by the different courts bring out a lot of questions by the public in the classical cases.
And we may find that the worries by the public on these judgments are the following:the principle-applied cases would be opposite the direction of the certainty of judgment and also be intent to the abyss of the moral judgment or the cover for the judges to abuse the principles and the most dangerous one is that the principle-applied in one single case justly would damages the certainty of the whole legal system deadly.
Chapter 2 is to discuss the reasons that make the principle judgments into the trap:the first one is that the ambiguous and ethical factors among the principle itself cause the uncertainty of the principle-applied judgments;the second one is that the similarity between the traditional model of the motional judgments and the principle-applied cases which induct the undemonstrated facts as the principles in judgments acceptably and could not get rid of this judgment model even nowadays while the "difference" of the two models gives the distinguished factor essentially.Therefore,the modern transformation in the tradition model should be exhibited in order to analyze the acceptance and misinterpretation of western principle judgments:at the beginning of the R.C.,Chinese judicature absorbed the legislated model of European continent as the word of "jurisprudence" and "principle" introduced into the legal system.
Thus the way of civil law in the legislation would be the principles at first alone the tradition of the classical model but not the article of the legal resources out of the written rules like the 1st Article of the regional civil law in Taiwan. Since the reconstruction of legal system in Chinese mainland in 80's of 20th century, the influential theory is the Dworkin's principles in laws in the academia.
Unfortunately, a few of the scholars in China realize the great differences between the Dworkin's theory and the traditional theory concerning the principle-applied judgments. Comparatively, the continental model is more similar with the real situations in Chinese principle judgments and oppositely there are few specific models about the continental principle judgments in Chinese legal communities and the works of introductions are launched in recent years.
So this sort of "misinterpretations" and "post-interpretations" make the effects on the indifferent attitudes in academia and the orderless situation in the applications. The last two parts in the paper are the outlets for the principle-applied judgment. At present situation that the low capacity of the judges in China, we may research the resolution in the following two aspects:the perfection of methods and the regulation of process. On the first side, we should clear out the connotation of the legal principle primarily and on the second one we should discuss the applied fields and methods of the principle judgments as the samples of the continental model.
And the fields are the following three:one is that the pre-understanding of the legal principle by judges;two is that the judicial reasoning of legal principle and the methods as the judicial rules of legal principle.And the focus is the later one in this part such as the chances,the specific ways,the construction of case models and the balance for the conflicts of principles etc.As for the regulation of process in principle judgments, we should learn form the legislations of civil laws in the continent and Taiwan area at first to establish the orders and legal resources outside the legal rules as a certain direction for the discretion.
Surely some scholars have raised that the "quality of the facts" could be the standard and the others considered that the 1st Article of civil law in Taiwan should be the "principle" for the out-of-rules judgments. After the comments about the ideas above,the author believes that we should take the common sense about "legal principle" as the last legal resource for this kind of judgments better under the situations of China and the foreign states and areas.
Finally the regulation of judicial process about the principle judgments is discussed as the following points:one is to enforce the arguments in the judicial papers to guarantee the legal principle changed into the practical legal reasoning;two is to enhance the authority and acceptance for the principle judgments; three is to enhance the judicial ranks for these principles-applied cases in light of the low professional qualities in some regional courts; four is to establish the certain boundaries of the cases in the bulletin based on the classical models of the legal principle-applied cases for the certainty of these judgments.
What is the last illustration in this paper is that how to get a correct judicial judgment would be a very perplex question and the principles-applied cases with the great debates have more problems in this direction. Examining the basis, there are various factors among the angle of "morality" about the judges such as the problem of the magnificent judicial system and the judicial corruptions. So this dissertation could not give a comprehensive study from all the perspectives but only chose the standpoint of methodology of principle-applied judgments in order to improve the "talents" of judges in these cases,which is an important issue emphasized by this text.

Direito à intimidade e internet

Uma interessante entrevista com Nicolas Poirier, especialista em direito na internet, revela as dificuldades de compatibilizar a intimidade e a divulgação de dados pessoais em sites da internet, especialmente aqueles de relacionamento. Podem ser usados como prova? Podem, amanhã, ser usados contra a pessoa que os disponibilizou, mesmo sem o seu consentimento? Há um direito ao esquecimento?

Le cas de cette utilisatrice de Facebook a secoué le web: en arrêt maladie pour dépression sévère, son assurance a suspendu ses indemnités au motif que son profil Facebook la montrait souriante, en vacances, etc. Ces questions évoquent aussi le pouvoir des entreprises privées dans la manipulation des données personnelles disponibles sur le web. Dans le temps, on peut également raccrocher ce thème à celui du droit à l’oubli. Nicolas Poirier, Responsable Juridique JFG Networks / Overblog a accepté de répondre à nos questions dans cette interview.
Des juristes comme Me Alain Bensoussan estiment que Facebook n’est pas un espace privé, qu’en dites-vous ?
La destination de Facebook est par nature d'être un espace public. Cependant, les limitations techniques prévues par le service permettent de le rendre strictement privé si on le souhaite. Pour information, la jurisprudence considère qu'un employeur qui accéderait à un dossier clairement revendiqué privé sur l'ordinateur de son employé, quand bien même l'ordinateur appartiendrait à l'entreprise, serait dans l'illégalité, et un licenciement motivé sur cette intrusion dans un dossier privé serait abusif.Certes, si un de ces amis travaille pour le Fisc, la Caf, les Assedics ou la gendarmerie, il peut utiliser les informations que vous publiez pour vous trahir, si ces informations concernent ses fonctions. Autrement dit, si un agent de la Caf se crée un profil bidon pour devenir votre ami sur Facebook et ainsi récolter des infos sur vous, sa décision sera dépourvue de fondement légal.
Quelles sont les conditions pour qu’une information publiée sur un profil Facebook serve de preuve ?
En premier lieu, pour être valide, tout constat fait sur internet et qui vous est opposé doit avoir été fait par un huissier : pas de constat d'huissier ? Foncez supprimer l'élément litigieux, et vous gagnerez toute procédure qui suivrait.Ensuite, une information publiée par vous, si elle l'a été sur un profil privé et indiqué comme tel, EST une information privée, c'est ce que dit la jurisprudence.Enfin, et contrairement aux affirmations de Me Bensoussan, avocat spécialisé en droit de l’Internet, il existe bien de la jurisprudence en la matière, notamment une décision d'un tribunal correctionnel ayant relaxé un motard qui avait filmé sur Youtube ses exploits de vitesse, considérant la vidéo comme insuffisante pour prouver quoique se soit (voir cette actualité)
Vous êtes juriste pour JFG Networks, l’éditeur d'Overblog.com, comment gérez-vous au quotidien ces questions de vie privée sur ces milliers de pages où quantité de données sensibles (photos personnelles, etc.) sont disponibles ?
D'abord, et contrairement aux idées reçues, nous ne recevons pas des milliers de demandes par jour relatives à la protection de la vie privée ! Au plus, nous en recevons une vingtaine par semaine, dont toutes ne sont pas justifiées. Paradoxalement, c'est le fait que les médias se penchent soudainement sur la question qui entraîne une augmentation - temporaire - du nombre de notifications relatives à la vie privée. En ce qui me concerne pour Overblog, environ 80% des demandes relatives à la vie privée sont justifiées et entraînent un retrait immédiat du contenu notifié. Pour les 20% restant, il s'agit de demandes malintentionnées ou injustifiées : j'ai ainsi reçu une fois une notification de l'ex-concubine d'une personne demandant le retrait des photos de cette personne avec sa nouvelle concubine ... Quoiqu'il en soit, chaque demande est traitée au cas par cas, et j'essaye de faire en sorte que ce soit en un temps record. Au plus, cela prend rarement plus de 48h pour qu'une demande ait reçu une réponse, positive ou négative.
La LCEN ne vous demande pourtant pas d’être juge des atteintes à la vie privée. Comment trancher le dilemme ?
La LCEN demande d'intervenir sur le contenu « manifestement illicite ». En ce qui me concerne, lorsqu'une personne me notifie qu'elle a constaté sur un blog des photos d'elle privées, encadrées de commentaires injurieux, je me doute que cette personne n'a certainement pas donné son accord pour une telle diffusion, qui plus est dans ce contexte, et j'assimile cette atteinte à la vie privée à du manifestement illicite. En insérant cette définition de « manifestement illicite », la LCEN fait de facto des responsables juridiques des plates-formes d'hébergement des « juges des atteintes à la vie privée », mais je pense que tout le monde comprendra que c'est d'abord à chaque fois du cas par cas, et que c'est surtout dans l'intérêt des personnes visées par l'atteinte que d'avoir un interlocuteur chez l'hébergeur, plutôt que d'avoir à aller devant le juge...
Finalement, ces questions sont en filiation directe avec le fameux droit à l’oubli, dont on entend aujourd’hui beaucoup parler. Que vous inspire ce concept ? Pensez-vous qu’il faille l’ériger en droit constitutionnel, comme le préconise Alex Türk ?
Je demande à tous d'être extrêmement prudents sur cette fameuse notion de « droit à l'oubli ». D'abord, les hébergeurs interviennent normalement immédiatement pour toute notification de contenu manifestement illicite : si une photo de vous se trouve sur un site, un blog sans votre autorisation, le droit à l'image vous autorise à en demander le retrait (attention aux cas particuliers, notamment les photos de groupe). Je m'étonne donc que l'hypothèse de la demande de retrait de photos « compromettantes » soit le principal argument ressorti le plus régulièrement pour justifier la création de ce fameux droit à l'oubli, notamment par le président de la CNILl Alex Türk : pour moi, le droit à l'image se suffit déjà amplement. Par ailleurs, j'appelle à la vigilance de chacun : je me doute que le législateur agit avec les meilleures intentions du monde lorsqu'il souhaite instaurer un droit à l'oubli, mais pour moi, il est évident que ce droit à l'oubli pourrait aussi et surtout malheureusement servir à un politique, qui aurait au cours de son mandat fait des déclarations maladroites ou mensongères, de se refaire une « virginité » sur le réseau à l'approche d'échéances électorales, au détriment de la nécessaire information des électeurs. Au regard de ce risque-là, et parce que je trouve que globalement, un internaute dispose déjà aujourd'hui de l'arsenal juridique nécessaire pour faire retirer des éléments propres à sa vie privée, alors je suis plutôt contre la création d'un « droit à l'oubli ».

Direito constitucional e soberania

Este texto é continuação do ensaio sob título A influência das constituições no debate “cooperação e conflito” do sistema internacional – que pretende incorporar as idéias contemporâneas acerca do Direito Constitucional Comparado a um trabalho mais amplo que se inscreve sob o título provisório de A construção de regras do direito como fator de distensão das relações internacionais.
A essência do termo soberania do Estado Moderno, em sua dimensão externa – a de não reconhecer autoridade que lhe imponha vontade não consentida – talvez seja um construto político que tenha contribuído para gerar em alguns momentos históricos um mundo conflitivo.
Convém inicialmente questionar: a soberania é de fato uma condição sine qua non para a existência do Estado? Jellinek (citado por ARIOSI) afirma que a soberania não é um elemento essencial do Estado. Para ilustrar sua hipótese, Jellinek utiliza o período medieval como exemplo considerando-se que os feudos eram unidades estatais, pois possuíam os elementos essenciais (território, população e governo), mas não eram entes soberanos. (JELLINEK, George. Teoria General Del Estado. Buenos Aires: Editorial Albatroz, s/data, pp. 356-366). Já no pensamento de Karl Marx, a concepção de Estado soberano, como a conhecemos, não significa necessariamente o melhor arranjo do sistema internacional; é apenas uma forma de concebê-lo.
Credita-se ao jurista francês Jean Bodin (1530-1596) – considerado por muitos o pai da Ciência Política – o mérito de ter formulado pela primeira vez uma teoria sobre soberania, a partir de sua obra Os Seis Livros da República. É bem verdade que seu objetivo era destacar a necessidade de uma concepção da soberania do poder real, em um mundo concebido sob uma ótica hobbesiana do “homem como lobo do homem” em um alegórico estado da natureza. De todo modo constitui uma referência histórica importante como contraponto de um mundo diverso dos dias atuais.
Como resultado das revoluções burguesas da primeira metade do século XIX, surgiram as teorias democráticas e com elas a expressão soberania popular, principalmente após a publicação da obra O Contrato Social (1762, Rousseau). O contrato social, na visão de Rousseau, é um acordo entre indivíduos para se criar uma sociedade, e só então um Estado. O contrato é, pois, um pacto de associação, não de submissão. Nessa linha de argumentação, a soberania popular tem como fundamento a igualdade política dos cidadãos e o sufrágio universal, sendo o titular da soberania o próprio povo, que a exerce por intermédio de seus direitos políticos. Esse conceito evoluiu para a idéia de soberania nacional, na qual a titularidade é deslocada para a nação, que representa o povo organizado numa ordem instituída como um complexo indivisível. Pode-se dizer que, o que diferencia a idéia de soberania popular, defendida por Rousseau, da idéia de soberania nacional, é a participação política, pois, a primeira reconhece a todos os cidadãos direitos políticos, e a segunda limita a participação àqueles investidos pela nação na escolha dos governantes.
O conceito de soberania nacional foi adotado após a Revolução Francesa, sendo a concepção geral que predomina até os dias atuais nos Estados que se organizam como democracias constitucionais. Nessa nova formulação do conceito de soberania, a maior parte dos estudiosos a classificam como una, indivisível, imprescritível e inalienável.
É importante destacar as constituições como suporte máximo dos modernos Estados democráticos de direito, podendo ser a elas creditadas a vitória do jus positivismo reinante nos séculos XIX e XX, alterando substancialmente as relações de poder com as monarquias.
Apesar de o poder constituinte, por definição, ser livre de vínculos jurídicos, pode existir limites objetivos a essa liberdade. Como assinala VERGONTINI (2004, p. 138), esses limites se relacionam a exigência de se respeitar os princípios transcendentes do direito natural e aos princípios inerentes à concepção mesma do Estado que se quer adotar, como o predomínio da soberania do Estado central sobre os estados membros caso se queira emprestar o formato de Constituição federal.

As fundações e ciclos constitucionais

Ao iniciar um trabalho sobre ciclos constitucionais, não nos poderemos furtar de falar, ainda que sem muita profundidade, sobre o que significa o termo “Constitucional”. Este, em sentido lato, é entendido como que representando um sistema baseado em um documento elaborado por uma reunião de homens reunida exatamente para fazê-lo. O termo foi muito útil para fazer uma separação entre a monarquia absoluta e a monarquia parlamentar, como, por exemplo, seria a forma de governo instaurada depois da Revolução Gloriosa de 1688, na Inglaterra.
É muito comum a confusão entre o termo Constitucionalismo e os diferentes meios para se atingir o ideal de Constituição, confundindo-se Constitucionalismo com a divisão de Poderes, sendo que o termo Constitucionalismo engloba em seu estudo todos esses meios na busca do modelo constitucional mais próximo do ideal.
Muito dessa crença está estreitamente vinculado a concepção política de Constituição oferecida no Constitucionalismo clássico.

Interpretação conforme a Constituição

A necessidade de uma análise histórico-comparativa dos elementos que propiciaram a moderna concepção do direito público subjetivo à educação
A interpretação liberal clássica afirma que os direitos fundamentais são direitos destinados a assegurar a liberdade dos indivíduos frente à atuação estatal. É nesse sentido que se considera serem direitos de defesa e, portanto, direitos a ações negativas do Estado1.
A dogmática atual dos direitos fundamentais tem como uma de suas questões principais e mais discutidas a referente a saber se, e em que medida, tais direitos correspondem também a normas que conferem direitos a ações positivas (prestações estatais)2.
A problemática se torna mais evidente no âmbito dos direitos sociais, típicos direitos a prestações3. Utilizando expressão de Andreas Krell, esses configurariam direitos "através" do Estado e não "contra" ele, na medida em que dependentes de uma prestação material a ser concedida pelo Estado4.
