Hierarquia de normas

Giorgio Pino escreveu um bom artigo sobre hierarquia normativa que se relaciona diretamente com o tema da supremacia constitucional e dos processos de inconstitucionalidade. Eis o sumário:



L’oggetto di questo lavoro è una analisi di alcuni possibili significati a) del concetto di “esistenza” riferito ad entità giuridiche, e b) del concetto di gerarchia normativa. In particolare, dopo aver distinto disposizioni e norme, vengono individuate tre differenti dimensioni dell’esistenza sia di disposizioni che di norme: l’efficacia, la validità, e l’applicabilità. Sono inoltre individuati tre distinti significati di “gerarchia normativa”, e ciascuno di essi viene messo in relazione ad alcune delle dimensioni di esistenza (di disposizioni o di norme) viste sopra.

For decades, legal academics have struggled with the “countermajoritarian difficulty”: the problem of justifying the exercise of judicial review by unelected and ostensibly unaccountable judges in what we otherwise deem to be a political democracy.
